The government has opened a consultation setting out a range of proposals to reduce ill health related job loss.
The proposal can be found here: https://www.gov.uk/government/consultations/health-is-everyones-business-proposals-to-reduce-ill-health-related-job-loss/health-is-everyones-business-proposals-to-reduce-ill-health-related-job-loss
One proposal of interest to employer is a new right to request workplace modifications on health grounds for those employees who do not meet the definition of a disabled person under the Equality Act 2010 and are not, therefore, covered by the obligation to make reasonable adjustments.
Other proposals include reform to statutory sick pay and to strength statutory guidance to support employers to take early, sustained and measured steps to support an ill employee to return to work prior to being able effectuate any dismissals on grounds of ill health capability.
We will keep abreast of any changes that might be implemented as a result of the reform and keep you updated accordingly.
